Buyer not paid and hasn’t left feedback for other auctions?

I have a buyer who has bought and paid for a couple of paintings recently, and has now won a third. But it’s been 10 days since the sale and they havent paid. Not wishing to pressurise the buyer I’ve only just issued a reminder invoice – still no payment. I don’t feel that I can open a case as the buyer has yet to leave feedback on the previous sales. Can I get the payment and not incur negative feedback? Has Ebay already opened a case automatically? To be honest, I’d just be happy to be free to auction the painting again.
